1. Introduction

Welcome to Dwellr. These Terms of Service ("Terms") govern your access to and use of Dwellr's website, mobile application, and services (collectively, the "Platform"). By using our Platform, you agree to be bound by these Terms.

Dwellr provides an end-to-end real estate marketplace connecting landlords and prospective tenants in Nigeria. We facilitate secure payments via Escrow, identity verification, and dispute resolution.

2. User Agreements

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Our platform enforces strict identity and property verification standards. Providing false documents is grounds for immediate account termination and potential legal action.

3. Tenant Rights & Responsibilities

Tenants have the right to a physical viewing of the property before moving in, unless explicitly waived.
Tenants must ensure payments are made directly through the Dwellr Escrow system. Any payments made outside the platform void Dwellr's buyer protection.
Tenants are responsible for truthfully declaring co-tenants and employment status during the application phase.

4. Landlord Obligations

Landlords are required to uphold high standards of integrity on the Dwellr Platform.

Landlords must provide accurate representations of listed properties, including current photographs and correct amenity descriptions.
Landlords must possess valid ownership documents and supply them during the verification stage.
Properties must be handed over in the agreed-upon condition on the expected move-in date.

5. Escrow & Platform Fees

5.1 The Dwellr Escrow System

All property transactions on Dwellr utilize our secure Escrow system.

When a Tenant makes a payment, funds are held securely until the Tenant confirms successful move-in and key handover. Funds are automatically released to the Landlord 7 days after the Landlord marks the keys as handed over, unless a Dispute is raised by the Tenant.

5.2 Service Fees

Dwellr charges a standard 4% Platform Fee on the total rental transaction amount. This fee covers:

Escrow management and security
Property and identity verification costs
Digital tenancy agreement generation
Access to 24/7 dispute resolution services

6. Dispute Resolution

If the property condition does not match the listing, the Tenant has the right to freeze the Escrow payment by raising a Dispute before the 7-day auto-release period expires.

Our admin resolution team acts as the final arbiter in all disputes. Both parties must submit relevant evidence (photos, messages, videos). Dwellr reserves the right to issue full refunds, partial refunds, or release funds in full to the landlord based on the evidence provided.

7. Termination

We may suspend or terminate your account and your access to our Services at our sole discretion, for any reason, without prior notice or liability. Common reasons for termination include utilizing alternative payment routes to circumvent the platform fee, repeatedly listing unverified properties, or engaging in fraudulent behavior.

If your account is terminated, any funds held in Escrow will be resolved according to the circumstances of the termination.
